The Limited Stay Permit (ITAS) is a permit that provides access for foreigners to engage in activities within a specified period in Indonesia. The fastest way to obtain a ITAS is by obtaining a Limited Stay Visa (VITAS). VITAS is generally classified into two categories: working or non-working.
Based on Article 141 of Law No. 48/2021 concerning Immigration, Limited Stay Permit (ITAS) is granted to:
- Foreigners entering Indonesian territory with a Limited Stay Visa;
- Children born in Indonesian territory whose father and/or mother hold a Limited Stay Permit at the time of birth;
- Foreigners whose status is changed from a Visit Stay Permit;
- Captains, crew members, or foreign experts on ships, floating vessels, or installations operating in Indonesian waters and jurisdictional areas in accordance with regulations;
- Foreigners legally married to Indonesian citizens; or
- Children of foreigners legally married to Indonesian citizens.
Applications for limited stay permits are submitted by Foreign Workers or their sponsors to the Head of the Immigration Office or Immigration Officials within the jurisdiction of the worker’s domicile.
Limited stay permits are granted for a maximum period of 5 years and can be extended for a cumulative maximum of 10 years. For VITAS holders, a period of 180 days is granted and cannot be extended, thus it must be converted into a limited stay permit.
Fees related to the Compensation for the Utilization of Foreign Workers (DKPTKA) can be outlined as follows (Article 2 of Regulation of the Minister of Manpower No. 15 of 2022 concerning Non-Tax State Revenue Management Derived from Compensation Funds for the Utilization of Foreign Workers):
- Set at USD 100 per month for each Foreign Worker;
- Employers hiring Foreign Workers for less than 1 month are required to pay DKPTKA for 1 (one) full month.
- Payment of DKPTKA is made by the Employer by depositing funds into the State Treasury through SIMPONI using a Billing Code that includes:
- Employer’s identity;
- Foreign Worker’s identity;
- Period of RPTKA Approval; and
- Total payment.
